Welcome to Dey’s Medical (UP). These Terms & Conditions (“Terms”) govern your access to and use of the website deysmedicalup.com (the “Site”), products, and services offered by us (“we”, “us”, “our”). By accessing or using the Site, or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site.
1. Definitions
- Customer / You: Any person who uses the Site to browse or order products.
- Products: Hair oils, hair serum, and other goods that we make available for sale via the Site.
- Order: A request by you to purchase Products from the Site.
- General Trade Outlet: Physical retail locations carrying our products.
- WhatsApp Order: Orders placed via our WhatsApp number +91 8981225807.
2. Use of the Site
- You must be at least 18 years old, or of legal age in your jurisdiction, to use this Site or place orders.
- You agree to provide accurate, current, and complete information (such as name, address, contact details) whenever you create an account or place an Order.
- You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.
3. Products, Pricing & Payment
- All product descriptions, images, prices, weights, dimensions, and other such details are provided in good faith. We make reasonable efforts to ensure accuracy. However, we do not warrant that all product descriptions or other content are entirely free of errors, and we reserve the right to correct them.
- Prices shown include GST where applicable and any other mandatory charges, but shipping / delivery charges may be additional unless stated otherwise.
- We accept payments via methods available on the Site (credit/debit cards, UPI, etc.), and via WhatsApp orders if arranged. Payment must be made in full at the time of Order (unless an alternate arrangement is clearly stated).
- In cases of Failed Payment (e.g., card declined) we reserve the right to cancel the Order.
4. Order Acceptance & Cancellation
- Once you place an Order, we will send you a confirmation (by email / WhatsApp / SMS) acknowledging receipt. This is not acceptance of the Order. Acceptance occurs when we dispatch the Product.
- We may refuse or cancel an Order for any reason before dispatch. Reasons may include incorrect pricing, stock unavailability, suspected fraud, or issues with delivery address.
- If your Order is cancelled after payment, we will refund the paid amount using the same payment method (or other mutually agreed method) within a reasonable time.
5. Delivery / Shipping
- We deliver products to the address you provide. You are responsible for ensuring correctness of delivery address and related details.
- Estimated delivery times will be mentioned at checkout or communicated via order confirmation. These are estimates; delays beyond our control (e.g. courier delays, customs, weather, strikes) may occur.
- Risk of loss and damage to the Products passes to you upon delivery. It is your responsibility to inspect the Product at delivery and report any visible damage or defects immediately.
6. Returns, Refunds & Exchanges
- If a Product is defective, damaged or not as described, notify us within [insert timeframe, e.g. 7 days] of receipt. Provide sufficient proof (photos, description) to help us assess the issue.
- We may offer a refund, replacement, or exchange for such Products, as per our policy. Return shipping may be borne by us if the fault is ours; otherwise, you may bear reasonable cost.
- Non-defective Products (e.g. chosen in error) may be returned or exchanged only if permitted by law and our policy. In such case, products must be unused, in original condition and packaging.
- Refunds will be processed once we receive the returned product (if applicable) and verify condition. Refund timeframe may vary depending on payment method & bank or payment processor.
7. Intellectual Property
- All content on the Site — product names, logos, images, designs, text, trademarks — are owned by or licensed to Dey’s Medical (UP), and are protected by applicable copyright, trademark, and intellectual property laws.
- You must not reproduce, distribute, modify, display, or otherwise use our intellectual property without prior written permission.
8. Limitation of Liability
- To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with your use of the Site, products, or inability to use them.
- Our total liability to you for any claim shall not exceed the price you paid for the specific product giving rise to the claim.
- We do not warrant that the Site will always be available, uninterrupted, error-free, or secure.
9. Disclaimer of Warranties
- Products are offered “as is” unless otherwise stated. We disclaim all warranties, whether express or implied, to the fullest extent permitted by law, including fitness for a particular purpose, merchantability, non-infringement.
- Natural ingredients may have slight variations in color, texture, or smell; these do not constitute defects.
10. Third-Party Links & Services
- Our Site may include links to third-party websites, services, or content. These are provided for your convenience; we do not control them and are not responsible for their content or any harm resulting from your use of them.
- If you use payment gateways, couriers, or other third-party services in relation to your order, those services’ own terms and policies apply to you in addition to ours.
11. Privacy
- Your use of the Site also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you agree to the terms of the Privacy Policy.
12. Changes to Terms
- We may revise these Terms occasionally. If we do, we’ll update the Effective Date at the top. Continued use of the Site after such changes constitutes your acceptance of the new Terms.
- For significant changes, we may provide notice (e.g. email or site-notice) where possible.
13. Governing Law & Dispute Resolution
- These Terms and your relationship with Dey’s Medical (UP) shall be governed by and construed in accordance with the laws of India, and jurisdiction of Indian courts.
- Any disputes, claims or controversies arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts in [City, State—e.g. Kolkata, West Bengal] unless otherwise required by applicable law.
- Before any legal proceeding, you agree to attempt to resolve the dispute via our grievance redressal mechanism (contact us at: care@deysmedicalup.com or via toll-free / WhatsApp) within [period, e.g. 30 days] of your notice.
14. Compliance & Consumer Rights
- We comply with all relevant Indian laws including, but not limited to, the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020. 15. Severability
- If any clause in these Terms is held to be invalid, unenforceable, or illegal under applicable law, that clause will be struck out, but the remaining clauses will still remain in full force and effect.
